Bizzy.co.uk provides its financial information services to you subject to the following terms and conditions

BY USING THE SERVICES YOU ARE DEEMED TO HAVE ACCEPTED ALL OF THE NOTICES, TERMS AND CONDITIONS SET OUT ON THIS PAGE BELOW AND IN OUR REFUND POLICY AND PRIVACY POLICY.AND AGREED TO BE BOUND BY THEM. YOU MAY NOT USE THE SERVICES IF YOU DO NOT ACCEPT THESE TERMS.

Bizzy.co.uk reserves the right to modify all or any part of these Terms or make changes to the Services or to withdraw the Services or any part of them at any time at its own discretion and without notice to you.

It is therefore recommended that you revisit these Terms regularly so that you are aware of the Terms in force at any particular time. You will be deemed to be bound by those Terms prevailing at each time that you use the Services and each such use shall be a separate, discrete transaction based on the then prevailing Terms.

Any service messages which may occasionally be published (other than revisions of products and pricing) and any statements or timings provided by any staff or help menu are intended for informal guidance only and do not form part of your contract with Bizzy.co.uk

Customer The individual or organisation using Bizzy.co.uk's services found at http://bizzy.co.uk or http://bizzy.info
Download Area An online account area where the Customer downloads documents.
Prices and fees Bizzy.co.uk reserves the right to alter our prices without notice. The fees agreed between Bizzy.co.uk and the Customer for provision of online business services to the Customer.
Order A single instance of a user specifying their preferences for document download, viewing online or printing.
Services Documents, supplied to the Customer in any form, PDF, HTML or any otherwise by Bizzy.co.uk, along with any scores, that the Customer orders.
Server The computer(s), connected to the internet, that hosts the various components of Bizzy.co.uk's services functionality, and on which and from which these services are executed.
Third party(ies) Suppliers of company data provided to Bizzy.co.uk for resale.
User An individual, usually identified by name and email address, who may create one or more orders.
Visitor A non-authenticated Customer or non-registered user or visitor to the website.

Working day / office hours Monday to Friday 0900 to 1730 GMT, excluding UK Bank Holidays.

General

This agreement constitutes the entire agreement and understanding between Bizzy.co.uk and you. It supersedes any previous agreement or understanding and may not be varied except in writing between us. All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

Any notice required or permitted to be given by either party to the other under these Terms shall be in writing addressed to the other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.

No failure or delay by either party in exercising any of its rights under this agreement shall be deemed to be a waiver of that right, and no waiver by either party of any breach of this agreement by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

If any provision of this agreement is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of this agreement and the remainder of the provision in question shall not be affected.

Any dispute arising under or in connection with this agreement or the Services shall be referred to arbitration by a single arbitrator appointed by agreement or (in default) nominated on the application of either party by the President for the time being of The British Computer Society in accordance with the rules of The British Computer Society.

This Agreement shall be governed and construed in all respects in accordance with English law and the parties irrevocably agree to submit to the sole and exclusive jurisdiction of the English Courts. The Services are not directed at people in any other country and should not be relied upon by people of any country other than the United Kingdom. You are responsible for compliance with the laws of your local jurisdiction regarding the use of the Services.


Service Description

Bizzy.co.uk's service enables Customers to order credit reports and company documents for delivery by internet and email. Upon receipt of an order our systems will perform the gathering of required data and deliver an email to the Customer with instructions to use the website. Software on the server then generates the document and sets up an email to be delivered to an internet email address supplied by the user. The purchaser accepts that they will not publish, modify, resell or share this information with any other party and also accepts the terms set out in Bizzy.co.uk's Refund Policy and Privacy Policy.

The details of the order are recorded on the server. Credit card details are NOT saved on our servers. The order details are retained on the Bizzy.co.uk server and made available to the Customer via the Bizzy.co.uk Download Area.

Some user emails are returned to our mail server marked as undeliverable. The most common reasons for this are that either the data size of the email is larger than a fixed limit of the user's system or the user's email box is full (i.e. disk quota exceeded).


Warranties, Liability and Disclaimers

Bizzy.co.uk is a distributor and not a publisher of third party aggregated content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available to the user via the website are those of the respective author(s), suppliers and distributors and not of Bizzy.co.uk.

Therefore your use of this Website is at your own risk. We do not represent or warrant that the contents of our Website is accurate, complete, useful, up-to-date or accessible although we have endeavoured to ensure that the content of the Website is correct at time of publication. This Website is not intended to be for your specific needs. We do not accept any liability for the contents of the Website or its accessibility. You should verify the accuracy of any information before you act upon it. By showing links to other Websites we do not give any approval or endorsement and we accept no liability for loss arising from your following such links or using any service. Bizzy.co.uk shall not be liable for any typographical or other errors or omissions in the Services.

Except as may be specifically stated herein, to the fullest extent permitted by applicable law, in no event shall Bizzy.co.uk, nor any of its directors, employees or other representatives be liable for any damages, loss or claim of any kind howsoever arising out of or in connection with the use of the Services including (without limitation) compensatory, direct or indirect, special, punitive, consequential or exemplary damages, lost profits, lost sales or business, lost data or inability to use data, loss of or damage to property and claims of third parties irrespective of whether Bizzy.co.uk or any of its directors, employees or other representatives has been informed of, knew of, or should have known of the likelihood of such damages. This limitation applies to all causes of action including (without limitation) breach of contract, breach of warranty, negligence, strict liability, misrepresentation and other torts, although Bizzy.co.uk does not seek to limit its liability for death or personal injury caused by their negligence.

If Bizzy.co.uk's limitation of liability set out in this agreement shall for any reason whatever be held unenforceable or inapplicable in whole or in part, or in the event that a judgment is awarded against Bizzy.co.uk arising out of your use of the Services (other than in the case of death or personal injury) you hereby agree that Bizzy.co.uk's entire liability to you or anyone claiming through you, whether in tort or contract, arising out of any one incident or series of connected incidents shall in any event not exceed 2,000 GBP in aggregate or three times the cost of all documents you have purchased from Bizzy.co.uk in the 12 months preceding the date of any claim, whichever is the higher.

By their very nature, some of the facts or opinions you receive from the Services may be open to dispute, particularly by the subject company or its directors, or considered damaging or defamatory. If you breach any of the terms set out in these Terms and Conditions relating to the use of or dissemination of information from the Services, you agree to indemnify in full Bizzy.co.uk against all liabilities, claims, costs and expenses which they may incur as a result.


Service Level Agreement

We agree to supply Bizzy.co.uk's services to the following service level:


Service availability

Our aim is for the server to be available for the recording and processing of orders 24 hours a day, 7 days a week, each day of the year. From time to time the Bizzy.co.uk server may be unavailable, or unable to record and process orders, for reasons within our control (i.e. scheduled maintenance) or beyond our control (e.g. unscheduled maintenance, hardware failure, malicious attack).

During periods of scheduled unavailability, and if possible to do so, the server will display an appropriate message to users if an attempt is made to use the website.

We will take whatever steps we believe reasonable to avoid unavailability for reasons beyond our control, including locating the server in a secure data centre with high capacity internet connections, and contracting for continuous monitoring and support with our chosen supplier for these services, but we do not guarantee such unavailability will not occur. No refund or compensation is available for any reason should the service being unavailable for any time.


Backup Schedule and Order Data Availability

Once in every 24 hour period we will take a back up from the Bizzy.co.uk server of all order data, and remove the backup to a separate physical location from the Bizzy.co.uk server. In the event of a partial or complete restore from backup of order data becoming necessary, we will do so within one working day of the necessity becoming apparent to Bizzy.co.uk, from the most recent valid backup available.

The website service enables Customers to download pre-ordered reports and document images from the server at any time of the Customer's choosing and thereby to save a copy at a location of the Customer's choosing. Customer's who attach commercial value to their order data are advised to ensure this is performed regularly. We do not guarantee availability of historic order data. We disclaim any liability for any monetary value Customers attach to order data or for that data's lack of availability from the website service.


Technical Support - Acknowledgement and Actions Taken

Customers may request technical support at any time by telephone or email. We will publish telephone numbers and email addresses for this purpose. During a working day, we aim to acknowledge, by telephone or email, the Customer's request within 30 minutes of receipt. Outside of the working day we will acknowledge the Customer's request, at the latest, within 45 minutes of commencement of the next working day.

Upon acknowledgement we will immediately assess the request and its effect on Bizzy.co.uk's services and take action based on the result of our assessment according to the following table:

Commence action to correct the issue within 2 working days, continue until issue is resolved. Keep Customer informed of progress and when corrective action is completed.
Issue has negligible effect on the current or future effectiveness or availability of Bizzy.co.uk's services, to the extent that Customers or users would generally be unaware of the issue. Issue will be scheduled for resolution in the next maintenance upgrade of Bizzy.co.uk's services. Customer informed of this decision and notified when the upgrade is completed.
Issue has no effect on the current or future effectiveness or availability of Bizzy.co.uk's services. No further action taken, Customer informed accordingly.

Restrictions on Use of the Services

We may make a search with a credit reference agency, which will keep a record of that search and will share the information with other businesses. We may also make enquiries about the principal directors with a credit reference agency.

You are entitled to use the information on the Services for your own private personal use only. You may electronically copy and print in hard copy portions of the Services solely for your own private personal use. You may not use the Services or any part or copy of the Services for any commercial purposes. Any use or reproduction of the Services or any part of the Services (other than private personal use), or any modification, distribution, communication or republication of the Services or any part of the Services without the prior written permission of Bizzy.co.uk is strictly prohibited.


Intellectual Property

The data, information and material contained in the Services, all Website design, text and graphics and the selection and arrangement thereof and all software used to operate the Services and the trademarks, logos and other intellectual property used in connection with the Services are the property of Bizzy.co.uk. No licence of any such intellectual property rights is granted to you as a result of your use of the Services. Other product and company names mentioned in the information provided in the Services may be the trademarks of their respective owners.
